Definitions
Fairy developer refers to www.fairydeveloper.com and/or any affiliate that will offer you services.
“TOS” refers to the Terms of Service (this document) and all of its contents.
The aggregate term “services” refers to both the services we offer to you and the act of hiring us.
“Products” refers to both the services we offer to you and the things you buy from us.
We, us, or our refers to Fairy developer.
“You” and “your” refer to the individual, business, or entity that hires Fairy developer to provide services.
“Web Design” and “website” refer to all aspects of the website (code, design, modifications, templates, material, photographs, images, text, functionality, illustrations) that Fairy Website Design has created or is in charge of.
The term “Graphic Design” refers to all elements of graphic design (ideas, graphics, templates, samples, photos, pictures, and text) created or managed by Fairy developer.
Terminology Application
- ALL SERVICES PROVIDED TO YOU BY FAIRY DEVELOPER ARE SUBJECT TO THE FOLLOWING TERMS OF SERVICE. THE USE OR ACCESS OF OUR WEBSITE AND THE PURCHASE OF OUR SERVICES CONSTITUTE YOUR AGREEMENT WITH THESE TERMS OF SERVICE.
- The sole use of the website that will not result in a binding agreement is a quotation, but this will happen with any other uses of the site or when you choose Fairy Developer to provide you with any service.
Creating a Website
2.1. All files created during, during, and after a Web Design project remain Fairy Developer’s intellectual property, with the exception—and only if the customer specifically requests it—of any photos, sources, or text documents supplied by the client for the building of the website.
2.2. There is NO EXCEPTION to this regulation for any custom web design packages; a management Fairy developer representative must sign a paper approving the exception or put it in the quote document.
2.3 Each developer shall be free to use, disclose, exhibit, make derivative works from, distribute, transmit, and reproduce any item from any web site developed for any customer or client, unless otherwise stated upon the payment of the web site, as long as no restrictions are placed on such usage.
2.4. The client unconditionally guarantees that all content—whether it be an image, text, animation, graphic, or other type of artwork—presented to Fairy Developer for inclusion in their web design project is either their property or they have permission or a licence from the elements’ rightful owners. The client also agrees to hold Fairy Developer and its affiliates harmless from any lawsuit or claim arising from the use of those elements.
2.5. Any suggestions, methods, or concepts made by the client for the creation of websites may be used in any way and for any purpose, unless the client expressly objects at the time the material is provided.
2.6 Fairy Developer is not responsible for any monetary losses incurred as a result of domain or hosting renewal or registration. All websites that Fairy Developer develops must be hosted by Fairy Developer for the entire time that the website is active.
When the client gives a web site their final approval, the design process will come to an end. Normally, this is accomplished by emailing the client or invoicing them fully. If a design is accepted, the client assumes full liability for any faults, modifications, or adjustments (with the exception of 2.7 in this agreement).
2.8. Fairy Creator retains ownership of any information and works posted on the aforementioned website when granting any reimbursements.
2.9. To begin working on your custom website design project, Fairy Developer needs a deposit of 50% of the total amount owed. As stated in section 2.10, the remaining balance is due prior to the fulfilment of your transaction.
2.10 Although we will strive to estimate a timetable for the development of your project, it is impossible for us to make any guarantees in this regard. You should not schedule any launches, materials, or anything else around a specific date, and all advertised timescales should simply be used as a reference. Fairy Developer is not liable for any delays that occur with your project. Without incurring a cost to the client, a project delay cannot be cited as a justification for termination.
Design & Graphic
3.1. Any files created during, before, and after a Graphic Design project remain Fairy Developer’s intellectual property, with the client’s permission only if expressed upon delivery of any photos, references, or text documents submitted for the construction of the Graphic Design.
3.2 Fairy Developer is free to use, disclose, display, publish, transmit, make derivative works of, distribute, and reproduce any element of any graphic design produced for any customer or client, unless it is specifically stated otherwise upon payment for the aforementioned graphic design.
Any content—whether it be an image, text, animation, graphic, or other type of artwork—presented to Fairy Developer for inclusion in their graphic design project is unconditionally guaranteed by the client to be their own or to have permission or a licence from the elements’ rightful owners. The client also agrees to hold Fairy Developer and its affiliates harmless from any lawsuit or claim arising from the use of said elements, and to hold them harmless from any liability.
3.4. The customer’s ideas, approaches, or concepts for the creation of graphic design may be utilised in any way and for any purpose, unless the client expressly objects at the time the information is provided.
3.5. The design procedure will come to an end when the client gives the Fairy Website Design their final approval. Normally, this is accomplished by emailing the client or invoicing them fully. Once a design has been authorised, the customer is solely liable for any errors, revisions, or alterations.
Internet Service
4.1. The client is bound by the terms and conditions of any third-party e-commerce solution used on their website, according to clause
4.2. Fairy Developer shall not be held accountable for any monetary losses brought on by the usage of any e-commerce website. 6.1. Connections to and from third-party websites Fairy Website Design
ANY PAGE ON Fairy Web Design MAY BE LINKED TO, PROVIDED THAT YOU AGREE TO THE FOLLOWING TERMS:
7.1 Fairy Developer reserves the right to delete or edit any linked website or links to its website if deemed inappropriate or in violation of any of the following:
Links to and from websites with deviant content, such as pornographic material and offensive language, are included in 7.1.1.
Links to and from websites that Fairy Developer deems undesirable are listed in section 7.1.2
Links to or from websites that disparage Fairy Developer or any of its activities (section 7.1.3)
Links to and from websites that give the impression that Fairy Website Design is associated with them or otherwise connected to them are listed in 7.1.4.
Links to/from websites that violate intellectual property rights (illegal activities and various permission-related issues) are listed in Section 7.1.5.
7.2. Fairy Developer is not responsible for the content found on websites belonging to third parties that are connected to and through Fairy Developer.
Fairy Developer DOES NOT support any links or user-generated content that is uploaded on its website or any other page on its website.
7.4 You recognise and agree that Fairy Developeris not responsible for any loss or damage that you may suffer as a result of a third party’s or external sites’ or resources’ availability.
Pricing adjustments
8.1. With the client’s permission, Fairy Developer reserves the right to modify the documented or stated price of any service or provision of an external service at any moment during the design and development process. The ultimate price for the good or service will take into account the price change.
8.2 Pricing for Fairy Developer’s goods and services are subject to change at any time, including during and before the design and development phase of any Web Design or Graphic Design with the addition of new jobs, goods, services, designs, or developments. The ultimate price for the good or service will take this price adjustment into account.
8.3 Fairy Developer reserves the right to cancel any project if the client is unavailable for a prolonged period of time (14 days or more), which makes communication necessary for the project’s completion difficult, unless prior written notice has been given and all outstanding balances on the client account have been paid.
Compatible Browsers
9.1 To guarantee that your website is accessible across many platforms, we offer a comprehensive list of browsers.
9.2 A cost that is based on the number of additional browsers you request must be paid if you want support for more browsers.
Responsibility
10. Fairy Developer does not support or permit unlawful conduct. All content on Fairy Developer websites and on FairyWebsiteDesign.com is only meant for consenting adults in jurisdictions where it does not contravene local laws or regulations. You hereby recognise that you are aware of and agree that materials displayed on Fairy Developerand on any Fairy Developerwebsite may not include explicit material of an adult nature or violate any local laws or ordinances. We are acting as your designer when we create a website for you, and we disclaim all liability for any legal problems resulting from improper usage of the website. The use of your website does not subject Fairy Developer to any liability for commercial or financial losses. While we make every effort to prevent data loss, we disclaim all liability in the event that data or information is lost due to our hosting service.
How to break up with Fairy Website Design
11. The terms and conditions will remain in effect until:
(A) any of the content in this document has been violated and the violating party has had 14 days to fix the violation.
(B) Both parties produce a written agreement with their respective signatures on it and mutually agree to it (C) The breach is irreparable.
(D) Fairy Website Design no longer makes the goods or service available to you.
(E) Fairy Developer is legally obligated to do so (F) You and Fairy Developer mutually agree to end your agreement for web design or graphic design services.
The Terms of Service may change
12.1 The Terms of Service are subject to change at any moment by Fairy Developer. Modifications to the Terms of Service will be uploaded and made accessible at 12.2, and you acknowledge and agree that by using any service or accessing the website on that date, you are deemed to have accepted the revised or additional Terms.
